Welcome to School Thinker, a product developed and operated by Devzuno Technologies Private Limited ("Company", "we", "our", "us"). These Terms & Conditions ("Terms") govern your use of the School Thinker platform, our website, and our associated services (collectively, the "Service"). By registering a school account, accessing, or using the Service, you ("School", "Administrator", "User") agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using School Thinker, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you may not access or use the Service. We reserve the right to amend these terms from time to time, and continued use of the Service constitutes acceptance of those changes.

2. Account Responsibilities & Security

As a School Administrator, you are responsible for maintaining the confidentiality of your account credentials, including passwords. You are solely responsible for all activities that occur under your account, including actions taken by teachers, students, and staff authorized by you. You must immediately notify us of any unauthorized use of your account.

3. Acceptable Use Policy (AUP)

You agree not to use School Thinker for any unlawful purpose or in any way that interrupts, damages, or impairs the Service. Prohibited activities include: uploading malicious code, spamming users, attempting to reverse-engineer the platform, or uploading content that is discriminatory or violates intellectual property rights. Violation may result in immediate account termination.

4. Subscriptions, Billing, and Payments

School Thinker operates on a subscription-based model. Subscription fees are billed in advance on a recurring schedule and are non-refundable. Failure to pay fees within the designated grace period may result in the suspension or termination of your account and loss of access to your data.

5. Limitation of Liability

School Thinker is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, School Thinker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Service.

6. Intellectual Property (IP) Rights

All software, design, code, graphics, and branding on the platform belong exclusively to School Thinker. Users are granted a limited, non-exclusive, non-transferable license to use the Service. You may not copy, resell, sublicense, or reverse-engineer the platform.

7. User Data & Content Ownership

The School retains full ownership of all data, text, and media uploaded to the platform ("User Content"). However, the School is solely responsible for the accuracy, legality, and validity of the User Content. By uploading data, you grant us a worldwide, royalty-free license to host, store, and process this data solely to provide the Service.

8. Service Availability & Maintenance

While we strive to maintain 99.9% uptime, we do not guarantee uninterrupted access. The platform may occasionally be unavailable during scheduled maintenance or due to unforeseen technical issues. We will make reasonable efforts to notify you in advance of planned downtime.

9. Force Majeure

School Thinker shall not be held liable for failure or delay in performing obligations under these Terms if caused by circumstances beyond its reasonable control, including acts of God, natural disasters, internet blackouts, government actions, or cyber-attacks.

10. Indemnification

You agree to defend, indemnify, and hold School Thinker and its affiliates harmless from any claims, damages, obligations, losses, or costs arising from your misuse of the Service, violation of these Terms, or violation of any third-party right.

11. Third-Party Services

School Thinker integrates with third-party services (e.g., payment gateways, SMS providers). We do not control these services and are not legally responsible for any failures, data breaches, or downtime caused by them.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

13. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
